Is forex trading halal in the UAE?

Short answer

In the UAE the fiqh answer is the mainstream one — spot currency trading with immediate settlement, no overnight interest and modest leverage is permitted by a broad group of contemporary scholars — but the verification standard is higher than elsewhere. The UAE embeds AAOIFI standards in financial supervision and its Higher Shariah Authority oversees Islamic financial institutions, so an Emirati trader can and should ask for a documented Shariah basis rather than a marketing label.

Trading in the UAE — the local picture

The UAE is the Gulf's retail-trading hub and the commercial value of the search is the highest of any market we measured: roughly 210 searches a month for 'is forex trading halal' at a CPC above $7, with 'swap free broker' at $10 CPC. These are people about to open accounts.

Both regulators matter. The SCA licenses onshore securities and commodities firms; the DFSA regulates firms inside the DIFC, which operates its own common-law framework. A broker that is 'regulated in Dubai' may hold either licence, or neither — check the register rather than the banner on the website.

AAOIFI is headquartered in Bahrain and its standards are the reference point across the Gulf, including for UAE Islamic banks. That means a UAE trader asking whether an account is Shariah-compliant can ask a precise question: which AAOIFI standard, and who signed off?

The UAE's Higher Shariah Authority supervises Shariah governance in UAE financial institutions. A UAE-licensed Islamic product will have a documented Shariah board. A swap-free trading account at an offshore CFD broker almost never does, and that gap is worth understanding before assuming the two are equivalent.

SCA (Securities and Commodities Authority) and DFSA (DIFC)

The UAE licenses retail derivatives onshore through the SCA and inside the DIFC through the DFSA, and it is the jurisdiction where AAOIFI standards are most directly embedded in financial supervision. That combination makes it the easiest market in which to verify a Shariah-compliance claim rather than take it on trust.

Shariah considerations Emirati traders actually weigh

AAOIFI's Shariah standard on currency trading accepts the standard spot convention as satisfying the hand-to-hand requirement of sarf. This is the basis on which spot forex is permitted at all, and it is the standard most Gulf scholars work from.

Leverage remains contested. One position treats broker leverage as a qard (loan) tied to a benefit and rules it impermissible; another treats it as a margin facility and permits it provided no interest accrues. Gulf scholars are found on both sides, so an Emirati trader choosing the cautious path uses the lowest available leverage.

Gold is the instrument that trips up UAE traders most, because Dubai's gold market makes physical gold familiar. Gold is ribawi: the exchange must be immediate on both sides. Physical gold in a vault you hold is straightforward; a leveraged gold CFD held overnight with a financing charge is not the same transaction and is not judged the same way.

What makes an individual account impermissible is almost always the overnight swap, which is riba, so the account structure is what you verify.

Is a broker 'regulated in Dubai' the same as regulated?

Not necessarily. Onshore firms are licensed by the SCA; DIFC firms by the DFSA. Some firms market a Dubai presence with neither licence. Check the relevant public register before you deposit — it takes a minute and it is the single highest-value check you can run.

Does an Islamic account at a CFD broker have a Shariah board?

Usually not. UAE Islamic financial institutions have documented Shariah governance under the Higher Shariah Authority. An offshore broker's swap-free account is typically a commercial product feature with no Shariah board and no certification. Ask who approved it and on what standard — and treat silence as your answer.

Is XAUUSD or gold CFD trading halal in the UAE?

Gold is ribawi, so classical fiqh requires immediate settlement on both sides. Physical gold you take possession of is straightforward. A leveraged gold CFD held overnight incurs a financing charge unless the account is genuinely swap-free, and gold is the instrument most often left out of a swap-free waiver — check the instrument list in writing.

Do I pay Zakat on UAE trading profits?
