Spot forex vs CFD vs swap-free CFD — which is halal for Muslim traders?
The three products look the same on a trading screen, but Shariah rules on the underlying contract, not the interface. Here's how spot forex, standard forex CFDs, and swap-free CFDs actually compare — and which one contemporary scholars accept.
Spot forex (Islamic account)
Real currency exchange, settled T+2, on a permanent swap-free account — the strongest halal option.
- Both currencies are real assets exchanged between counterparties (sarf)
- T+2 settlement is widely accepted as 'same sitting' by contemporary scholars
- Zero overnight interest under any name on a genuine Islamic account
- Available with modest leverage on FCA/ASIC/DFSA-regulated brokers
Swap-free CFD
A CFD with no overnight interest — accepted by most contemporary broker Shariah boards, disputed by classical-leaning scholars.
- No overnight swap or administration fee tied to the interest differential
- AAOIFI-aligned Shariah boards at several brokers have approved this structure
- Underlying instruments must still be Shariah-screened (no brewery stocks, conventional banks, etc.)
- Minority view: still lacks qabd (possession) — some scholars discourage it altogether
Standard forex CFD
A CFD with overnight interest financing baked in — riba on every held position.
- No currency changes hands — the trader never possesses anything
- Daily swap charges/credits are riba by definition
- Fails both qabd (possession) and the sarf immediacy requirement
- Cannot be fixed by intention — the contract itself is the problem
Our recommendation
Choose spot forex on a genuine Islamic account when possible — it's the strongest structural fit. If your broker only offers CFDs, use a verified swap-free CFD account with AAOIFI-aligned Shariah oversight, keep leverage modest, and stick to Shariah-screened underlyings. Never use a standard CFD account for held positions — the overnight interest is riba regardless of your intention.
